These Terms of Service ("Terms") are a binding agreement between you and IWantToPractice LLC, a Massachusetts limited liability company, trading as Muzie ("IWantToPractice," "Muzie," "we," "us," or "our"). They govern your access to and use of the Muzie website at muzie.live, the Muzie application at app.muzie.live (and, during our migration period, the legacy application at muzie.studio), and related products and services (together, the "Service").
By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. Please read these Terms carefully and keep a copy for your records.
What Muzie is. Muzie is an all-in-one platform for music education that lets teachers and studios run live online, in-person, and hybrid lessons and manage their studios, and lets students practice and track their progress between lessons.
By using the Service or emailing us, you consent to receive communications from us electronically (by email and through the Service), and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.
You are responsible for maintaining the confidentiality of your account credentials, for restricting access to your devices, and for all activity that occurs under your account. Notify us promptly at user.support@muzie.live of any unauthorized use. You may not share, assign, or transfer your account to anyone else. We are not responsible for loss arising from theft or misuse of your credentials. We may refuse service, suspend or terminate accounts, or remove or edit content, in accordance with these Terms.
You agree not to use the Service to: violate any law or the rights of others (including privacy, publicity, and intellectual-property rights); upload or share content that is unlawful, infringing, defamatory, obscene, harassing, or harmful; record anyone in violation of applicable recording-consent laws; upload viruses or malicious code; attempt to gain unauthorized access to, damage, overburden, or interfere with the Service or others' use of it; scrape or harvest data or others' personal information without consent; reverse engineer, resell, or create derivative works from the Service; or remove or alter any proprietary notices. We may investigate and take appropriate action, including removing content and suspending or terminating accounts.
The Service includes features that let you communicate with others: in-app chat and direct messages, group chats, studio and teacher announcements, in-lesson polls and questions, and assignment submissions (collectively, "Communication Features"). You are responsible for your messages and materials. We have no obligation to monitor Communication Features but may review and remove content, and restrict or terminate access to them, at our discretion and as needed to comply with law or a legal request. Use caution when sharing personal information about yourself or your children. Views expressed by users are their own and do not necessarily reflect ours.
The Service and all content we provide, software, text, graphics, logos, images, and their arrangement, are owned by IWantToPractice or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms for your own use. We reserve all rights not expressly granted. "Muzie" and our logos are our marks and may not be used without permission.
We respect intellectual-property rights and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a notice with the information required by the DMCA to our designated agent:

We may remove allegedly infringing content and terminate repeat infringers.
The Service is built on third-party services that process data on our behalf, for example Stripe (payments), Twilio SendGrid (email delivery), Amazon Web Services (hosting and storage), and the AI providers named in our Privacy Policy. Scheduling emails may include standard calendar-invite (.ics) attachments you can add to your own calendar. The Service may also link to third-party sites we do not control; your use of them is governed by their terms and privacy policies.
THE SERVICE AND ALL CONTENT, SOFTWARE, PRODUCTS, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT INFORMATION (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE, OR THAT RECORDINGS OR OTHER CONTENT WILL BE PRESERVED. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IWANTTOPRACTICE AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH THE SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING IT.
You agree to indemnify, defend, and hold harmless IWantToPractice and its officers, directors, employees, and agents from any losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right (including recording-consent and parental-consent obligations under Sections 2 and 6). We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate.
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or as otherwise permitted by law. You may stop using the Service and cancel your subscription at any time (see Section 5). On termination, your right to use the Service ends; sections that by their nature should survive (for example, ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) survive. Handling of your data after termination is described in our Privacy Policy.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. You and IWantToPractice consent to the exclusive jurisdiction and venue of the state and federal courts located in Massachusetts for all disputes arising out of or relating to the Service or these Terms.
We operate the Service from the United States. If you access it from elsewhere, you are responsible for complying with your local laws, and you agree not to use the Service where prohibited.
We may change these Terms at our discretion. The most current version supersedes prior versions. If we make material changes, we will provide notice (for example, on the Service or by email) before they take effect. Your continued use of the Service after changes take effect constitutes acceptance.
These Terms, together with the Privacy Policy and any order or plan terms, are the entire agreement between you and IWantToPractice regarding the Service and supersede prior agreements on that subject. If any provision is found unenforceable, it will be modified to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. No joint venture, partnership, employment, or agency relationship is created by these Terms. We are not liable for delays or failures caused by events beyond our reasonable control. These Terms are drafted in, and will be interpreted in, English.
